1. Purpose

The purpose of having a Terms of Use statement is two-fold: i) it protects our ability to continue to provide excellent resources to churches, since most of our staff do this as a ‘tent-ministry’ it ensures that we are able to support ourselves and our ministry efforts; ii) it protects the rights of the photographers who support themselves through this. 

2. Types of Use

The acceptable uses vary according to the format purchased, as outlined below.

2.1 Projector, HD, TV-NTSC, TV-PAL
i) For projector, TV and computer (offline) use only! For TV broadcast an extended license must be purchased. ii) Not intended for distribution, print, or resale- in whole or in part; not to be used online. You may not take an image and alter it in anyway and try to resell it- don’t monkey with our work and claim it is yours! If you have a question about a particular use that is not directly stated above email us using the form in the Contact section.

2.2 Print
i) Intended for a single event use only- multiple uses within a single event are fine (i.e. you may purchase a print image for your Christmas service and use it in bulletins, on your invitations, thank-you cards, etc). Print images may be distributed via giveaways, mail-outs etc. (as long as it is within the realm of a single event usage and is free for recipient). ii) Not intended for resale in whole or in part, not to be used online. You may not take an image and alter it in anyway and try to resell it- don’t monkey with our work and claim it is yours! 2.3 Extended License
i) The extended license allows you to print our images for resale; it is limited to a single use- for every additional use an additional extended license must be purchased. Acceptable extended license uses include: magazine, calendar, postcards, etc. ii) Where-ever possible, please include the following credit/copyright notice: ©ImageVineStock.com (i.e. inside jacket cover of CD, under/beside image printed in magazine, etc.) iii) Broadcasting a TV image is permitted under the extended license. iv) You may not take an image and alter it in anyway and try to resell it- don’t monkey with our work and claim it is yours! 3. Website Restrictions

The following restrictions apply when using our images online: an image may be no larger than 400 pixels across and must be cropped to 50% of original text and/or a watermark must be embedded in the file so that the original image can not be accessed.; and/or banner size of 60 pixels high by 568 pixels wide. A link back to our site must be provided along with recognition for the image either next to/below the image, or in the links section of your site. We suggest purchasing the Projector or Print format for web use as the TV formats aspect ratio has been adjusted.

4. Ownership

ImageVineStock.com retains the rights of ownership to all images. You are allowed to use the images as outlined in the Types of Use. ‘You’ refers to the individual church or organization purchasing the image- the image may be used by several parties within that church or organization, as needed (i.e. projector operator, worship leader, etc.). Images may not be transferred from one church or organization to another.

5. General Terms

5.1 Length of Agreement
This Agreement is effective until it is terminated. You can terminate this Agreement by destroying the Content, along with any copies, and ceasing to use the Content for any purpose. The Agreement also terminates without notice from ImageVineStock.com if at any time you fail to comply with any of its terms. Upon termination, you must immediately (i) cease using the Content and for any purpose; (ii) destroy or delete all copies of the Content; and (iii) if requested, confirm to ImageVineStock.com in writing that you have complied with these requirements.

5.2 Warranties and Liability
i)ImageVineStock.com grants no rights and makes no warranties regarding the use of names, people, trademarks, trade dress, patented or copyrighted designs or works of art or architecture or other forms of intellectual property represented in any Content. While we have made reasonable efforts to correctly categorize and keyword the Content, ImageVineStock.com does not warrant the accuracy of such information.

ii) THE CONTENT IS PROVIDED “AS IS” WITHOUT REPESENTATION, WARRANTY OR CONDITION OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED REPRESENTATIONS, WARRANTIES OR CONDITIONS OF MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. IMAGEVINESTOCK.COM   DOES NOT REPRESENT OR WARRANT THAT THE CONTENT WILL MEET YOUR REQUIREMENTS OR THAT ITS USE WILL BE UNINTERRUPTED OR ERROR FREE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE CONTENT IS WITH YOU. SHOULD THE CONTENT PROVE DEFECTIVE, YOU (AND NOT IMAGEVINESTOCK.COM) ASSUME THE ENTIRE RISK AND COST OF ALL NECESSARY CORRECTIONS.

iii) ImageVineStock.com’s entire liability and your exclusive remedy, with respect to any claims arising out of your use of the Content, or out of your actions in downloading the Content, shall be as follows:
You may re-download the Content as needed by logging in to your account; you may also, via the email form under Contact, request assistance from ImageVineStock.com’s support department in order to resolve the issue.
If you continue to be unable to download the Content, ImageVineStock.com will refund the fee actually paid by you for such Content, provided ImageVineStock.com determines in its sole and absolute discretion that you have been unable to download such Content successfully.

iv)YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT IMAGEVINESTOCK.COM WILL HAVE NO LIABILITY FOR SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND IN CONNECTION WITH YOUR USE OF THE SITE, EVEN IF YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

5.3 Acknowledgement
BY PURCHASING OR DOWNLOADING CONTENT FROM THIS SITE, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS HEREIN. You further agree that it is the complete and exclusive statement of the agreement between you and ImageVineStock.com which supersedes and proposal or prior agreement, oral or written, and any other communication between you and ImageVineStock.com relating to the subject of this agreement.
